Leaving a Legacy

What will your legacy be? Leaving a gift in your Will to the Dunnville Hospital and Healthcare Foundation is an act of caring and compassion for your entire community.  You can designate a certain sum of money, a particular asset, or a portion of your estate. Whatever form your gift takes, the result is the same – exceptional healthcare close to home.

How to Give

To include a bequest to the Foundation in your Will, you can simply have your lawyer add a codicil to your existing Will, or you can have a lawyer or notary prepare a new Will for you and include the bequest at that time. A bequest can be made available for immediate use or held as an endowment.

Types of Bequests

Specific Bequest

You designate a specific dollar amount, or piece of property such as real estate, stocks, or bonds.

Residual Bequest

You donate all or a portion of your Estate (a percentage of your Estate) to the beneficiary after all your debts, taxes, expenses, and other bequests have been paid. This is typically done by designating a percentage or share of your Estate.

Contingent Bequest

Your gift takes effect only if the primary intention cannot be met (if, for example, the primary and alternate beneficiaries do not survive the donor).

Gift Restrictions

Unrestricted Gifts

If you wish to meet the most important needs of our hospitals, we recommend that your gift be unrestricted. An unrestricted gift allows the Dunnville Hospital & Healthcare Foundation to use your gift for the most important needs facing the hospital.

Restricted Gifts

You can control the use of your bequest by including certain designations in your Will. However, because our hospital needs are subject to change, we recommend that you add a “power to vary” clause to ensure your gift will deliver maximum value. See sample text for this below.

Sample Will Clauses

The following clauses have been prepared for use by legal and other advisors who are acting on behalf of clients who wish to make gifts by Will to The Dunnville Hospital & Healthcare Foundation. These sample clauses are intended to be examples only and may be amended to suit individual circumstances.

The Dunnville Hospital & Healthcare Foundation requests that advisors recognize the need for flexibility. Over time, the needs of Haldimand War Memorial Hospital and Edgewater Gardens will change due to program revisions, ministry directives, research and equipment innovations and other considerations. For this reason, should clients prefer to designate their bequest as to use or purpose, the Dunnville Hospital & Healthcare Foundation recommends the inclusion of a “power to vary purposes” clause (final paragraph).

Unrestricted Gift

I authorize and direct my trustee(s) to pay the sum of $____________, (or percentage share of my Estate) to the Dunnville Hospital & Healthcare Foundation in the town of Dunnville, Ontario, to be used for such purposes of the Foundation as its Board of Directors may from time to time determine; and I declare that the person who professes to be the Treasurer of the Dunnville Hospital & Healthcare Foundation or other person authorized to give receipts shall be sufficient discharge thereof.

Restricted Gift

I authorize and direct my trustee(s) to pay the sum of $___________, (or percentage share of my Estate) to the Dunnville Hospital & Healthcare Foundation in the town of Dunnville, Ontario, which sum is to be used for SPECIFIC AREA OF INTEREST WITH THE HOSPITAL; and I declare that the person who professes to be the Treasurer of the Dunnville Hospital & Healthcare Foundation or other person authorized to give receipts shall be sufficient discharge thereof.

Residual Bequest: Unrestricted Use

I authorize and direct my trustee(s) to pay the whole of (or percentage of) the residue of my Estate to the Dunnville Hospital & Healthcare Foundation, to be used for such purposes of the Foundation as its Board of Directors may from time to time determine; and I declare that the person who professes to be the Treasurer of the Dunnville Hospital & Healthcare Foundation or other person authorized to give receipts shall be sufficient discharge thereof. 

Endowment Gift

I authorize and direct my trustee(s) to pay the sum of $_______________, (or percentage share of my Estate) to the Dunnville Hospital & Healthcare Foundation in the town of Dunnville, Ontario, which sum to be held as part of its Endowment Funds, the capital of which shall be set aside and invested and the income from the sum is to be used for such purposes of the Foundation as the Board of Directors may from time to time determine;  and I declare that the person who professes to be the Treasurer of the Dunnville Hospital & Healthcare Foundation or other person authorized to give receipts shall be sufficient discharge thereof.

Bequest Contingency Clause

The following should be included in bequests:

If at the time of my death, the Dunnville Hospital & Healthcare Foundation is nonexistent, or has ceased to carry out its charitable objects, has amalgamated with another organization(s) or has changed its name or the location of its work, this bequest payable in favour of this Foundation shall not fail but my trustee(s) shall in their sole and absolute discretion pay the bequest or share of my Estate to the organization which in their sole and absolute discretion most closely resembles the Foundation I intended to benefit, provided that if such bequest shall fail for any reason, then I declare that, notwithstanding the particular form of such bequest, my paramount intention is to benefit a general charitable purpose. 

“Power to Vary Purposes” Clause for Designated Gifts

In the event that circumstances make the specific use of this gift no longer practical or desirable, the Board of Directors of the Dunnville Hospital & Healthcare Foundation in their absolute and sole discretion, is hereby authorized to make changes in its use consonant with the spirit and general intent of the gift.
